CIVIL WAR TULLAHOMA TENNESSEE SEXUAL ASSAULT COURTMARTIAL 1864

Description: During the American Civil War the commission of sexual assault was a capital offense, unlike the American Revolution where such assaults were underreported and often ignored by commanders. The US Army Civil War code of conduct severely penalized such acts but again accusations were seldom followed up. A rare Union Army Courtmartial General Order issued at the War Department, Washington, April 4, 1864 detailing charges against 3 men for various crimes , including the trial of Lt Harvey H John, 49th Ohio Infantry, who on August 8, 1863 did "forcibly and unlawfully ravish and carnally know Mrs Catherine Farmer, against the will of the said Catherine Farmer. This near Tullahoma, in the State of Tennessee and beyond the picket line of the 2d Division, 20th Army Corp, at said Tullahoma". The officer is also charged with straggling form his command of enlisted men detailed for the purpose of gathering berries, and with visiting the house of various citizens . The officer is found guilty and sentenced to be cashiered and given 2 years penitentiary imprisonment , the sentence approved by the President of the United States. 6pp 8 x 5". Each order, issued in writing by a command, was then printed for distribution to each unit, either at an army department headquarter or by commanders at local headquarters in the field on portable printing presses operated by soldiers. The orders were then issued to regiments, to be read aloud to the troops. General Orders were printed as issued with date & location; at the end of a year the regimental adjutant might retain them loose or simply string bind them by punching holes or cut slits in the left margin and stringing on ¼” red cloth string tape (the source of the old expression "government red tape"). Sometimes an officer or HQ clerk might take a group of orders to a local print shop or bookbinder and have an accumulation bound with leather or cloth covers.
